Reservation Policies
Welcome to Hayden Lake Marina! This Agreement ensures your experience is both safe and enjoyable. By signing below, you confirm that you have read, understood, and agreed to the terms and conditions outlined below.
1. Payment
At the time of booking, Lessee has made a partial payment to secure the rental. The remaining balance is due within 24 hours of the scheduled departure. Lessee has the option to purchase a damage waiver for added protection. There are no refunds; however, if rescheduling is necessary, Hayden Lake Marina will make reasonable efforts to accommodate changes. Lessee expressly authorizes Hayden Lake Marina to charge for any damage, loss, or harm to the Equipment and/or Furnishings if the damage waiver is not selected.
2. Condition of Rental Property
Lessee acknowledges that, prior to taking possession of the Equipment and Furnishings, they examined the items and found them to be in good and safe condition. Lessee accepts the Equipment and Furnishings "as is" and acknowledges that no warranties, express or implied (including warranties of merchantability or fitness for a particular purpose), have been provided. Lessee is responsible for liability and property damage insurance on the Equipment and Furnishings.
3. Responsibility for Equipment and Furnishings
Lessee is solely responsible for the Equipment and Furnishings from the time of rental until their return. If the Equipment or Furnishings are lost, stolen, or damaged—regardless of fault—Lessee is fully liable for all related costs.
4. Charges and Payments
- Cleaning fees ($50 for excessive cleanup).
- Late return fees ($50 per 15 minutes or part thereof).
- Replacement of lost or damaged items at full retail value.
- Labor costs for repairs or replacements.
- Lost rental revenue due to downtime for repairs.
Lessee agrees to pay all charges immediately upon demand. Any unpaid amounts may incur interest charges.
5. Operating Conduct
- All passengers under 13 years of age must wear a U.S. Coast Guard-approved Type III life jacket at all times.
- The engine shut-off lanyard must remain attached to the operator at all times while operating the vessel.
- Operators and passengers are prohibited from consuming alcohol before or during boat operation.
- Observe all posted speed limits and no-wake zones.
- Operate at no-wake speed (maximum 5 mph) when within 300 feet of a shoreline, swimmer, diver, dock, marina, or other structures.
- Maintain a distance of at least 300 feet from water skiers, tubers, and fishing boats.
- Avoid wake jumping and operating near other boats.
- Do not operate in less than 3 feet of water or in designated swim areas.
- Return to the dock by designated time of drop-off. Operation after dark is prohibited without navigation and anchor lights.
6. Maintenance and Cleanup
- Lessee must remove all trash before returning the boat. A $50 fee will apply for excessive cleanup.
- Any lost or damaged items, including propellers, will be charged in accordance with the Damage Waiver agreement.
7. Release and Indemnity
Lessee agrees to release and indemnify Hayden Lake Marina and its representatives from liability for any damage, injury, or loss arising from the use or operation of the Equipment and Furnishings.
8. Instructions
Lessee acknowledges receipt of proper instruction on the safe operation of the Equipment and capability to operate the Equipment safely and in compliance with all applicable regulations.
9. Collection Costs
Lessee agrees to pay all attorney fees, collection fees, and court costs incurred by Hayden Lake Marina to collect unpaid charges or enforce this Agreement.
10. Additional Users
Lessee may not allow others to operate the Equipment unless identified as an Additional User. Additional Users must also agree to the terms of this Agreement.
11. Severability
If any provision is deemed void, all other provisions shall remain in effect.
